NSA Litigation Closed

August 10, 2023 Yesterday, AAMS learned that our request for a summary
judgment in the No Surprises Act litigation (which later was consolidated with
similar filings from AHA, AMA and others) was denied in federal court.
Judge J. Leon issued an opinion accepting the HHS arguments and issued an
order closing the case. AAMS accepts the court ruling and will not be
seeking appeal.
AAMS will continue to advocate on our members behalf to ensure the No Surprises
Act and the Independent Dispute Resolution process is properly enforced. The
law, clear in its intent, timelines, and process, must be followed to ensure
the viability of emergency healthcare services.
AAMS is keenly aware that many of our members are experiencing long delays in
receiving payments after successful IDR efforts which is further straining an
already burdened critical safety net service of our healthcare system. AAMS
continues to work with its healthcare association partners to ensure the
sustainability of emergency healthcare services for our communities and to
support the dedicated professionals that provide these services.
